This special edition of Propertymark Pulse features Timothy Douglas, Head of Policy and Campaigns at Propertymark, discussing the implementation of the Renters’ Rights Act 2025, which came into effect on May 1, 2026.
Overview of the Renters’ Rights Act
The Act represents the most significant change to the rental sector in over 30 years. It will be implemented in three distinct phases, with May 1, 2026, marking the start of Phase One.
Key Changes in Phase One (Effective May 1, 2026)
Tenancy Reforms: All existing and new tenancies convert to periodic open-ended tenancies.
Section 21: The ‘no-fault’ eviction process has been removed for new tenancies.
Rent & Bidding: Rent increases are limited to once every 12 months, rent in advance is capped at one month, and rental bidding is banned.
Pets: Tenants now have a right to request a pet, and landlords cannot unreasonably refuse.
Information Sheet: Landlords must provide tenants with a government-issued information sheet by May 31, 2026.
Future Phases
Phase Two (Late 2026): Introduction of the Private Rented Sector (PRS) database, a register for landlords and properties .
Phase Two (2028): Establishment of the landlord ombudsman to handle redress.
Phase Three (2035): Introduction of the Decent Homes Standard, requiring properties to be free of Category 1 hazards and have better energy efficiency.
